47 Holiday Makers To Take Legal Action After Gastric Illness Strikes

Published date: 12 Mar 2009

A group of 47 British holiday makers are to take legal action after they were struck by a gastric illness whilst on holiday in Turkey last September.

Sarah Powell from Clacton-on-Sea, Essex travelled with her friend, Brian McCann and her four children to the Aqua Fantasy Hotel with First Choice. After staying at the resort for only a few days, they and other holiday makers were struck with severe symptoms of gastric illness.

Sarah Powell said “My family and I travelled to the Aqua Fantasy Hotel for a relaxing holiday but all members of my family became ill with diarrhoea and stomach cramps with the exception of one. The conditions at the Aqua Fantasy Hotel were terrible and I am angry that tour operators are able to continue to send guests to this hotel when the standards are so poor.

“I will not be travelling with First Choice again following their complete disregard for my family during this terrible experience.”

Philip Banks, a partner with Irwin Mitchell said: “It appears from the information that we have that there has been a significant outbreak of gastric illness amongst holidaymakers at this hotel.

Such illness can usually be avoided by basic hygiene measures being implemented by the hotel and this is something which should routinely be being checked by tour operators who send their guests to overseas hotels. The fact that we have been contacted by a number of holidaymakers indicates that these standards may not have been adhered to.

Sadly, we know from experience of other similar cases involving British holidaymakers, that a number of those who suffered illness on holiday are likely to suffer long term or even permanent health problems as a result of their initial infections. This is a matter of great concern and as well as seeking fair compensation for our clients for their illnesses, ruined holidays and other losses, we also call upon First Choice and all other British tour operators to ensure that they are taking all reasonable steps to make outbreaks of illness like this a thing of the past. ”

Irwin Mitchell urges anyone affected by this incident to contact them with further details.
