In March 2011, Mr B went on a skiing holiday with tour operator, Neilson, to Austria. The holiday went fine until the transfer ride to the airport. Mr B was picked up from his hotel on 12 March. However, there were some other passengers to pick up and the coach stopped at Scheffau to pick them up.
However the driver could not turn the coach around on the road and therefore decided to reverse the coach down the street. He failed to see a wall and crashed into it, causing the coach to precariously balance over a ledge.
As a result of the accident Mr B sustained severe whiplash injuries to his neck and back. Despite physiotherapy he is still suffering from his symptoms.
Irwin Mitchell have submitted a formal Letter of Claim to Neilson and await their response.
