Illness at Cacao Beach Hotel

Irwin Mitchell acted on behalf of two clients who travelled to the Cacao Beach resort in the Maldives during the summer of 2008. Both clients contracted symptoms of gastric illness.
 
Irwin Mitchell were instructed to act on behalf of a couple who travelled to the said hotel after they contracted symptoms of Diarrhoea, vomiting and stomach cramps. It was alleged that the illness was contracted from the food consumed at the hotel, due to the poor quality of food and lack of hygiene standards practiced at the hotel.
 
Whilst the acute symptoms of the illness were short lived, one of our clients experienced continuing symptoms which troubled her on a daily basis. A claim was therefore brought against the tour operator who provided the holiday package, First Choice Holidays and Flights limited.
 
We issued court proceedings in the Birmingham County Court as the parties were unable to reach an agreement on both liability and quantum. Shortly after serving legal proceedings on the Defendant, the parties agreed settlement, achieving £7,000 to be split between the clients.
