Rotating Fan Falls on Guest in Maldives Restaurant

Mr H instructed Irwin Mitchell after he sustained injuries after a rotating fan fell on his head in the restaurant of his luxury hotel in the Maldives.

Mr H and his wife were on a First Choice package holiday in the Maldives. They were sitting at a dining table when a rotating fan suddenly broke free from the ceiling above him. It fell to the floor, hitting Mr H’s head as it fell. The blades were still spinning. Mr H suffered a laceration to his head and cut to his ear. He received medical attention, which included stitches for the laceration and the split to his ear.

As the holiday was booked through First Choice, Irwin Mitchell proceeded to seek compensation for the personal injury Mr H sustained under the Package Travel Regulations 1992. Irwin Mitchell wrote to First Choice setting out the allegations of negligence to which a response was received admitting liability.

Irwin Mitchell are now in the process of quantifying Mr H’s claim in order to achieve an out of court settlement.

We were very happy with the outcome of our case, especially as we were initially offered nothing from the Tour Operator. Irwin Mitchell were very professional throughout and we are very happy with the outcome.
