Irwin Mitchell have secured an admission of liability following a road traffic accident in France, involving a motor caravan and delivery van.
Irwin Mitchell are acting for Mr and Mrs C, who took their motor caravan on a touring holiday of France in the summer of 2009. The couple had been travelling from Die, in the Drome valley, towards Lus-la-Croix –Haute, which is situated in the Buech valley. They reached the highest point on the country road, and took the opportunity to park their motor caravan off the road and have some lunch. Whilst having their lunch break, Mr C went for a walk to explore the area, whilst Mrs C remained in the motor caravan.
It was whilst Mrs C was in the motor caravan, that a delivery van driver lost control of his vehicle and collided with the motor caravan. Mrs C was thrown to the floor and suffered bruised ribs and a neck injury. She was rushed to hospital where she was admitted for two days.
As well as injuring Mrs C, the accident ruined the remainder of the couple’s holiday and caused them various financial losses.
Irwin Mitchell traced the UK claims handler for the delivery van’s insurers, and submitted Mr and Mrs C’s claim to them. Liability has been admitted, and we are now seeking a French lawyer’s advice on the value of the claim.
Although this road traffic accident occurred in France, it can be dealt with in this country thanks to European law.
