Road Traffic Accident in France
Irwin Mitchell have been instructed by Mrs V, who was injured in a car crash whilst staying at her holiday home in France, on Easter Sunday 2010.
Our client was a passenger in a car, being driven by her partner. The couple were travelling along a quiet country road, when a car coming from the other direction started to move towards their side of the road. Our client’s partner tried to take evasive action, but could not avoid a collision with the other vehicle.
After the accident, it transpired that the driver of the other vehicle had been talking to her passenger and had taken her eyes off the road. Our client has suffered whiplash injuries to her neck, which are ongoing. She has also been inconvenienced by not having the use of a motor vehicle while on holiday.
Under French law, Mrs V is able to claim compensation against the driver of her vehicle, even if the accident was not his fault. Mrs V has, however, decided to only pursue the third party driver.
Irwin Mitchell has now traced the UK Claims Handlers of the French insurers which allows us to bring Mrs V’s claim in this country. The Defendant’s have admitted liability and we are now in the process of submitting a valuation in respect of the losses Mrs V suffered as a result of the accident.
