Hotel Accident in Cyprus

Mrs Hoult was injured in an accident in Northern Cyprus.

In November 2002 the client and her partner left the hotel restaurant and went to their car, which was parked in a parking area opposite the hotel. It was dark. As the Claimant opened the car door her foot became stuck in a hole created by a gulley in the surface from which the protective grill had been removed.

As a result, she suffered a fracture of the neck of the left femur.

A claim was pursued against the tour operator, on the basis that they were liable for the negligence of the hotel, under the Package Travel etc Regulations 1992.

The Defendant denied liability, on the basis that the parking area, where the accident occurred, was a public road and not the hotel's responsibility.

We continued to pursue the claim, on the basis that even if the area was a public road, it was used de facto as a car park, by the guests of the hotel and restaurant.

Liability was never admitted by the Defendant, but the claim settled for £30,000.
