Ecuador raft accident
Mrs Poulton was on a fund raising
holiday in Ecuador. As she was being transported along the Rio Napa on a raft, the raft travelled
through a stretch of turbulent water and capsized. Mrs
Poulton drowned. Legal action was taken by Irwin Mitchell Solicitors against the tour operator in England on behalf of Mrs
Poulton’s estate to secure compensation for Mrs
Poulton’s young daughter.
It was alleged that Mrs Poulton died as a result of the capsizing of the raft due to allegedly inappropriate action by the boatmen employed by the tour operator’s agent.
Following the breakdown in negotiations between the parties, proceedings were issued on behalf of the estate of Mrs Poulton. The parties agreed to mediate the claim following which settlement was agreed.
Following the mediation, the Defendants agreed to pay to Mrs Poulton’s estate the sum of £140,000. This enabled Mrs Poulton’s daughter to have the upbringing and education that she had intended and worked so hard for.
After the claim had concluded, Mrs Poulton’s former husband, Quinton Poulton stated “I am very pleased by the professional service that has been provided by Irwin Mitchell in our case which has helped to provide for our daughter’s future as Sharron envisaged”.
