Compensation for Slip Accident Near Swimming Pool

On 24 December 2005 Mr Hemming was on holiday with his family at the Viva Maya Hotel in Mexico. On Christmas Eve he slipped on water round the pool that had not drained away properly and snapped his left Achilles tendon.
It was alleged that the hotel had an inadequate drainage system in breach of local Mexican regulations.
A claim was brought against First Choice as the Tour Operator who supplied the holiday as a package. First Choice did not admit liability initially and it was necessary to commence legal proceedings against First Choice.
Mr Hemming’s claim was eventually settled for £40,000.
