Accident In Spain - Compensation For Holidaymaker

Irwin Mitchell Solicitors acted for a client who sustained injury when he was involved in an accident in Spain. Our client slipped and fell in the bathroom of the Hotel Port Aventura, Salou.

One night during the holiday, in the early hours, the toilet system in his room began to overflow. The client reported the problem; a plumber attended and disconnected the water supply. The client and his family went out to a nearby water park the next day. When they returned, they found that someone had re-connected the water supply. As a result, the room was awash with water.  As he walked across the floor, our client slipped and fell.  He put out his left arm to break his fall, injuring it as a result. He sustained an injury to the cartilage of the wrist, causing pain and clicking.

Irwin Mitchell Solicitors brought a compensation claim on behalf of the client against First Choice, who admitted liability for the accident. Irwin Mitchell Solicitors were able to recover £13,000 in damages for the client.

The client is in receipt of means tested state benefits and his entitlement to these may have been affected by receipt of the compensation payment following his accident in Spain. To protect him from this, our firm’s Court of Protection department were able to set up a trust for the compensation funds.
