Mrs M and her 2 children (aged 6 and 7) went on holiday to the Bahia Principe Hotel in the Dominican Republic in 1997
.
She had saved for 3 years and also borrowed money from her family to pay for the holiday.
3 days into the holiday they all fell ill with gastric illness. Mrs M’s daughter recovered after 1 month and her son recovered after 10 weeks but Mrs M suffered from IBS (Irritable Bowel Syndrome) pre-holiday, however the infection slowly got worse and developed into a more serious level of IBS, likely to continue indefinitely.
Irwin Mitchell Solicitors brought claims on behalf of Mrs M and her family as part of a ‘group action’ with twenty two other people who also stayed at the Bahia Principe Hotel at the same time. Their group action was joined with 6 other group actions all brought against the same Defendant. In total, one hundred and ninety nine holidaymakers were involved.
Mrs M received £25,000 in compensation, and her children recovered £5,000 each.
Mrs M commented after the case, “My family’s claims did take a long time to settle but it was worth the wait. The Holiday Claims team made it an easy journey. They did all the hard graft. I knew my family’s claim was in capable hands. The biggest effort I had to make was travelling to see 2 medical experts, and that was small in comparison to the end result. “
