Mr C Maguire, went on an all-inclusive holiday to the Camino Del Sol Hotel, Cabarete, in the Dominican republic with his wife and 2 children.

Three days into the holiday, Mr Maguire began to suffer from symptoms of a gastric nature (diarrhoea, abdominal pains, stomach cramps and tenemus). His symptoms continued upon return to the UK as a result of which he had to have time off work. His symptoms also effected his social life. He developed intolerance to certain foods. After numerous tests and investigations medical experts concluded that his symptoms are unlikely to resolve completely and confirmed that the original gastrointestinal infection and ongoing problems are the result of post infective irritable bowel syndrome suffered as a result of his original infection at the Hotel Camino Del Sol.
A claim was issued on Mr McGuire’s behalf as part of a group action involving 16 Claimants in total against JMC Holidays Ltd in the Birmingham County Court. Liability was admitted by JMC and the claim successfully concluded as a result of subsequent settlement negotiation.
After careful negotiations, and bearing in mind the continuing nature of his symptoms since the holiday, the claim was settled for over £20,000.
