Artemis Hotel
Irwin Mitchell acted for 28 guests who had their holidays ruined due to illness during their stays at the Artemis Hotel in Protaris, Cyprus in June and July 1997 after booking their holidays with Airtours.
Guests who stayed at the hotel noticed that the hotel was not particularly clean. There was broken glass seen in the children’s play area and faeces on the walls of the mens toilets which was cleaned for several days.
One holidaymaker said “I noticed that food that had not been eaten at one meal would be reserved at the next meal. The hotel tried to disguise this fact by mixing the dishes together. On a few occasions the bread rolls were mouldy."
One man in his 30s from Wakefield suffered illness on holiday and was admitted to hospital in Cyprus. He has been left with life changing and lasting affects after being diagnosed as suffering from Irritable Bowel Syndrome and Chronic Fatigue Syndrome, both of which have had a severe affect on his lifestyle. With the assistance of Irwin Mitchell, he was awarded in excess of £40,000.
He said,” My whole life has been turned upside down as a result of my illness. Simple tasks are a struggle. Before my holiday I was a very fit person, I used to have so much energy I had to always be doing something. It has been extremely difficult and distressing to try and adjust to such a big change particularly as it all seemed to happen very suddenly."
A number of the holidaymakers who travelled to the hotel also suffered injuries after cutting themselves on broken tiles in the hotel swimming pool.
Airtours admitted it was at fault for the illnesses and ruined holidays. Following negotiations with the tour operator, Irwin Mitchell was able to recover damages totalling nearly £100,000 for the 28 holidaymakers. Airtours also agreed to pay their legal costs.
