Mr Jones was part of a group illness action involving 54 individuals in total.
Illness Outbreaks at Gran Canaria Princess Hotel, Gran Canaria
The Claimant arranged a holiday for himself and his partner, through Thomson Holiday’s, at the Gran Canaria Princess Hotel, Gran Canaria in September and October 2003. During his stay he contracted a severe gastric illness as a result of the poor hygiene standards at the hotel, most probably in respect of food preparation. Medical evidence was obtained from Dr Rees (gastroenterologist) to assist the claimant.
A claim was issued on behalf of Mr W at the Birmingham High Court against the tour operator, TUI UK Limited (trading as Thomson Holidays) , being part of a group of 54 individuals.
Liability was not admitted by TUI UK and Mr Jones was also required to prove his illness was contracted on holiday and that the long term symptoms were directly related to the enteric infection. The permanent ongoing symptoms of irritable bowel syndrome have had a significant effect on Mr Jones’ social life, to the extent that he rarely goes out with friends or family and can not play the sports he loves.
Mr Jones recovered £5750 in compensation.
Mr Jones commented after the case, “Everyone at Irwin Mitchell Solicitors was very helpful and professional. I am very happy with the result and the way the case was handled.”
