Mrs Belinda Kavanagh travelled to the Hotel Aguamar in Majorca with her husband and 2 children on an all inclusive package.

The hygiene standards at the hotel were poor, on the third day of the holiday she became ill with severe gastric symptoms. She experienced vomiting, diarrhoea, headaches and a high temperature.
Other family members and hundreds of other guests also suffered with gastric illness. The hotel manager, Tour operator representatives and a local Doctor insisted the illness was some sort of virus.
Mrs Kavanagh remained ill throughout the holiday and was exhausted as she also had to care for her family. The holiday was completely ruined.
Mrs Kavanagh was diagnosed as having contracted salmonella upon returning home. She has never returned to her pre-holiday state of health and is likely to have permanent gastric problems.
A claim was brought on behalf of Mrs Kavanagh as part of a group action for 651 Claimants against the tour operator, JMC.
Liability was admitted and Mrs Kavanagh recovered £704 diminution in value of the holiday, £1240 loss of enjoyment of the holiday, £120 enhanced loss of enjoyment, special damages £267 and £22,000.00 for pain suffering and loss of amenity bringing her total damages to £24,331.
