Mr and Mrs Pengilly were on holiday at the Hotel Bellevarde in turkey with their two children Issac and Jack.

During the second week of their holiday Ian and Kathryn fell ill with gastric illness, suffering from symptoms of diarrhoea, vomiting and abdominal pain.

Ian has been diagnosed with mild Irritable bowel syndrome for the foreseeable future.  Liability was admitted with the clients to prove causation and medical evidence was obtained which supported causation.

A claim was brought on behalf of Mr & Mrs Pengilly by Irwin Mitchell Solicitors against the tour operator, First Choice Holidays & Flights Ltd. Mr Pengilly recovered £10,765.28 in compensation and Mrs Pengilly, £8002.24.
