Irwin Mitchell acted for a family of 3 who stayed at the Bouganvilla Apartments, Santa Ponsa, Majorca in summer 2003. The family had many complaints about the hotel, including that the main toilets were filthy, the hotel pool was contaminated with diarrhoea and the hotel staff being generally unhelpful. As a result of poor hygiene standards at the hotel, each member of the family fell ill, suffering unpleasant gastric illness. The mother was confirmed as suffering a cryptosporidium infection, and her son was admitted to hospital. While both parents recovered within a short time, their son later developed Irritable Bowel Syndrome as a consequence of his holiday illness.
Irwin Mitchell was able to agree settlement of the family’s claim for more than £15,500 in total. The Defendant tour operator also agreed to pay the family’s legal costs.
