Irwin Mitchell have successfully recovered damages totalling over £350,000 from tour operator My Travel after 120 people became ill whilst on holiday at the Viva Azteca Hotel in Cancun, Mexico during July and August 2003.
The holidaymakers noted problems with the poor hygiene standards at the hotel which included undercooked food being served, reports of insects in and around the food and throughout the restaurant and reports of birds landing on the tables and flying in and out of the restaurant.
Many of the holidaymakers fell ill suffering with symptoms of diarrhoea, vomiting and stomach cramps. Many of those affected have been left with long term health problems, including Irritable Bowel Syndrome and Chronic Fatigue Syndrome, as a result of the illnesses contracted whilst on holiday.
Christopher and Debbie Reed from Redditch travelled to the Hotel in July 2003 with their daughters Antonia and Danielle in order to celebrate their wedding anniversary. Mr Reed was diagnosed with Shigella a bacterial infection which has led to long term health problems. With Irwin Mitchell’s help Mr Reed’s claim settled for over £26,000, Debbie Reed’s claim settled for over £18,000, Danielle Reed’s claim settled for over £19,000 and Antonia’s claim settled for £18,500.
