Irwin Mitchell Solicitors have recently been successful in pursuing a group illness action against the Tour Operator First Choice for holidaymakers who travelled to the Royal Park Hotel in Torremolinos in 2003.
Irwin Mitchell acted for a total of 35 Claimants who were affected by varying degrees of gastric illness following their stay at this hotel which resulted in some Claimants requiring medical treatment with a number of Claimant returning positive diagnoses for Salmonella.
Holidaymakers experienced a vast range of quality issues at the hotel during their stay including food being undercooked and left out for long period of time, abuse from hotel staff and rotten fruit being served in the fly infested buffet area.
Many of the holidaymakers who travelled to the hotel were families with young children and they found the health and hygiene standards at the hotel to be appalling and felt that the Tour Operator put them at risk by their blatant disregard for the claimants' safety and wellbeing.
Irwin Mitchell was successful in securing a total award of approximately £40,000 in damages for the group as a whole.
