Bellevue Apartments – 2003
Families successfully bring claims against two Tour Operators after holidaying at the Bellevue Apartments, Spain in 2003.
Irwin Mitchell represented 24 clients who holidayed at the Bellevue Apartments, Spain in 2003 and who fell ill with severe symptoms of gastric illness. Several clients were later diagnosed as having contracted Cryptosporidium, and there was one case of Giardia.
Clients brought claims against two Tour Operators, Air Tours and Island Blue. The clients complained that there were poor standards of hygiene at the hotel which they believed resulted in them falling ill. They stated that the pool and surrounding areas were extremely dirty and that the pool was not cleaned regularly. Additionally, they alleged that the hotel was infested with rats.
Following settlement negotiations with the two tour operators, all clients achieved satisfactory settlement awards in respect of their claims totalling almost £120,000, albeit that liability was denied. The tour operator also agreed to cover their legal costs.
