Las Chapas Hotel

Irwin Mitchell represented 42 holidaymakers who stayed at the Las Chapas hotel near Marbella, Spain in summer 2003. The all inclusive package holidays were booked with My Travel.

Following negotiations with the tour operator, Irwin Mitchell was able to achieve damages awards totalling tens of thousands of pounds for the 42 holidaymakers.  My travel also agreed to pay the claimants' legal costs.

One of the more seriously ill holidaymakers was 4 months pregnant at the time of her holiday.  She travelled with her husband and daughter.  She was disappointed with the hotel room which was basic and smelt of sewage. Along with other holidaymakers she complained that the hygiene standards were not very good, with all the food being served in metal dishes which were uncovered. There were lots of flies in the dining room and as much of the food was uncovered the flies were landing on the food. She complained that the tables and floor in the restaurant were dirty.  When food and/or drink had been spilt on the floor, nothing seemed to be done to clear it up.

On return to the UK she was diagnosed as suffering from Campylobacter and went on to develop Irritable Bowel Syndrome as a direct result of the initial infection.   She was awarded £12,500 in compensation.
