Santa Susannah Hotel, Costa Brava

Irwin Mitchell were successful in recovering compensation for a group of clients who travelled with Cosmos to the Santa Susannah Hotel in July and August 2001, after they suffered serious gastric illnesses due to a breakdown in food hygiene procedures at the hotel.

The guests’ quality complaints included poor hygiene standards within the hotel, relating to the restaurant, general cleanliness, and the attitudes of staff members.  Hygiene standards for the buffet were cited as a serious concern as many guests reported that food appeared to be undercooked, and the buffet food in particular was left out for long periods of time and was not covered. Guests also stated that they were told there was a microwave available if they need to re-heat the food. They also saw insects on and around the food.

Some holidaymakers had still not recovered months later and stool samples for some clients tested positive for Salmonella. Some guests continued to experience occasional problems with constipation and bloating which have affected their daily lives.

Cosmos admitted that they were liable for the claims and settlement negotiations resulted in Irwin Mitchell recovering substantial compensation for their clients.  The tour operator also agreed to cover their legal costs.
