Holidaymakers are awarded almost £33,000 in compensation after ruined holidays at the Hotel Dar Khayam, Hammamet, Tunisia 2001
Irwin Mitchell represented a family of 6 who all contracted gastric illness during their stay at the Hotel Dar Khayman in 2001. Their holidays were ruined when a breakdown in food hygiene procedures at the hotel caused all of them to suffer unpleasant gastric illness. The holidaymakers noticed that the salad was not chilled and were dismayed to see serving staff replenishing new food on top of old food. The holidays makers also commented that food that not eaten during lunch would simply be put out again for dinner. The swimming pool was really dirty and the bottom could not be seen. There were lots of flies and rubbish in the pool and at no time did the family see anyone clean the pool.
Tour operator JMC Holidays Ltd admitted liability and our clients were awarded a total of almost £33,000 in compensation. The most serious illness received £11,500 in compensation. The tour operator also agreed to cover their legal costs.
