68 holidaymakers win over £218,000 after stays at the Club Pomelan Hotel, Turkey in 1998
Irwin Mitchell represented 68 people whose holidays at the Club Pomelan Hotel in Turkey between May and September 1998 were ruined when 58 of them fell ill with gastric illness, which was caused by a breakdown in food hygiene procedures at the hotel.
JMC Holidays Ltd admitted that they were at fault and following settlement negotiations we succeeded in recovering over £218,000 in compensation for our clients. Fortunately most of our clients recovered from their illnesses within 2 months but several developed permanent Irritable Bowel Syndrome as a result of the infections they picked up during their holidays.
The highest award for the most seriously ill of our clients was over £10,500 to a child who stayed at the hotel with her parents and sister. They all fell ill within days of starting their holiday. The parents and sister all recovered within 2 – 3 weeks, but our client has never fully recovered. The medical expert concluded that she had developed Irritable Bowel Syndrome which was likely to be permanent. In total, the family were awarded over £25,000.
