£94,000 awarded to 65 holidaymakers after cryptosporidium outbreak at the Ozkaymak Hotel in Turkey in 2003

Irwin Mitchell acted for 65 people whose holidays to the Ozkaymak hotel in Turkey in summer 2003 were ruined when 63 of them fell victim to an outbreak of cryptosporidium.  Fortunately most of the holidaymakers recovered within a month, but some suffered longer term symptoms. 

Cryptosporidium is a waterborne parasite which causes unpleasant gastric illness.  It is often associated with swimming pools that are not adequately maintained or cleaned.  The unfortunate guests reported such failures in hygiene standards as seeing children having diarrhoea in and around the pool, but no action being taken to stop this or to clean the pool. 

Tour operator Thomas Cook denied that it was liable for the holidaymakers’ illnesses.  However, following negotiations between Thomas Cook and Irwin Mitchell the holidaymakers accepted settlement awards totalling £94,000.  Thomas Cook also paid their legal costs.
