Motor Home Accident In Australia
Irwin Mitchell have recovered over 50,000 Australian dollars, for a client who sustained serious leg injuries on the trip of a lifetime to Australia.
Our client and her husband, both motor home enthusiasts, had saved and planned for the holiday for ten years and planned to travel independently across Australia in a rented motor home.
Only a few days after collecting the motor home for a trip along the East Coast of Australia, our client attempted to disembark from the motor home when the step gave way underneath her causing her to fall onto her left ankle.
As a result of the fall, our client sustained a multiple fracture to her left ankle which had to be put in plaster and elevated. The entire holiday was ruined and a planned stopover in Hong Kong on the way home had to be cancelled.
Our client’s husband had the rental vehicle inspected and it became apparent that the motor home step was defective and rusted behind the mechanism making it very unsafe.
We brought a case against the Australian motor home rental company for renting the vehicle to our client in an unsafe condition. They denied liability throughout the claim but ultimately, we were able to have a settlement meeting and they agreed to pay our client significant damages, the equivalent of over £30,000 based on current exchange rates.
