Shanghai Airport Accident
Irwin Mitchell Solicitors are acting for a client who sustained injury following a collision with another passenger at Shanghai Airport.
Our client was on a package tour to Japan and China. The first leg of the tour involved flying from London to Tokyo, via Shanghai. The client sustained injury, while in transit between flights at Shanghai airport. While she was walking towards the departure gate, in order to board her connecting flight to Tokyo, another passenger collided with her, with his trolley, pushing her over. She sustained a fracture to her spine. The passenger, who collided with her, rushed away from the scene and could not be identified or traced.
The claim is being pursued against China Eastern Airlines. We argued that our client’s carriage with China Eastern Airlines was governed by the Montreal Convention on the Carriage of Passengers by Air and that, as our client was in the process of embarking at the time of her accident, the airline would be liable for the accident under the terms of the Convention.
The airline has now accepted liability to compensate our client for the bodily injuries sustained
