Swimming Pool Accident in Italy
Martin Dufficy, 13, was playing in a swimming pool at a villa in Italy when, just as he went to push away from the side, he caught his heal on the sharp edge of the submerged edge of the swimming pool ladder which did not have a rubber stopper on. As a result of the accident, Master Dufficy sustained a severe laceration to his heel leaving a scar. He was also not able to enjoy the rest of his holiday as the accident occurred on the first day.
The villa had been rented by Master Dufficy’s parents from the owner who was based in England. The owner agreed to compensate Master Dufficy for his injury, the consequential financial losses sustained by his parents and for the family’s loss of enjoyment.
The owner of the villa eventually agreed to settle the claim for £4,000 which was then approved by the court in view of Master Dufficy’s age.
