Claim for Canadian tourist after RTA in London

A 73 year old Canadian tourist, was walking across Kensington High Street, London -

On 11 July 2003 when she was struck by a vehicle being driven by the Defendant. As a result of the accident, the Claimant sustained a fracture to her collar bone, a fracture to her right knee, three broken toes to her left foot and a laceration to her right middle finger.

She was hospitalised in London for approximately two days before being flown home to her native Canada. Upon return to Canada, she required two surgical procedures on her right knee and she continues to experience ongoing symptoms. She has difficulty going up and down stairs, kneeling and squatting. In addition, she is unable to walk very far without an aching in her knee and she experiences a sense of tightness in that area. She also continues to experience ongoing symptoms in her shoulder.

Following extensive negotiations between Irwin Mitchell Solicitors and the Defendant’s insurers, settlement was agreed in April 2007 in the sum of £45,026.
