£140,000 for passenger following RTA in Portugal
Our client (aged in her 80’s at the time of the accident) was a passenger in a car being driven in Portugal by her husband. While traveling back from their home there, the driver lost control of the vehicle which came off the road and turned over. On impact the door of the vehicle opened and our client’s arm was dragged along the road. She sustained a serious injury to her left arm which subsequently had to be amputated. Our client also suffered other injuries including psychological injuries.

As the driver of the vehicle was domiciled in England, the claim could be brought in the jurisdiction of England and Wales. This was significant as we were able to obtain English levels of damages for our client and these were significantly higher than would have been awarded by the Portuguese courts.
Irwin Mitchell proceeded with a claim on behalf of our client against the insurers of the driver who settled out of court.
Our client recovered £140,000 in damages for injury and consequent financial loss and expenses.
