Six figure sum for Arctic Glacier Victims
Irwin Mitchell are pleased to announce that they have won compensation for holidaymakers who were injured whilst on a package holiday with Discover the World to see the Horn glacier off the coast of Spitzbergen.
As the Ship was navigated perilously close to the glacier, large chunks of ice calved from the glacier and fell into the sea. This caused a large wave to hit the vessel, the Alexey Maryshev, causing the ship to list violently, throwing the passengers onto the deck and across the ship thereby causing injuries.
Many of the claimants feared for their lives during the ordeal. Those most seriously injured were taken from the ship, by helicopter, for immediate medical treatment. The remainder of the passengers were treated onboard until the following day when the ship docked and they were able to obtain further treatment from a local hospital.
Irwin Mitchell submitted the claim to Discover the World who denied liability, following which court proceedings were issued. Discover the World eventually admitted liability in October 2010, but the value of the claim was disputed. The claim was due to be listed for trial in the first half of 2011, but Irwin Mitchell were able to settle the claims of the 12 victims that we represented for a six figure sum without the need to go to trial.
