£7,000 recovered following ski accident in France
This case involves a skiing accident, which took place in France. The circumstances of the accident are the third party skier collided with our client. Our client sustained a number of injuries including a fractured tibia and fibula in her left leg, scarring on her left knee, below the knee, above the ankle and in front of the ankle. In addition, our client sustained neck pain and back pain. She also sustained bruising on her right forearm.
Compensation Claim for Skiing Accident
French agents were instructed to obtain a copy of the police report and to advise on liability. The French agents advised us that prospects of succeeding in this claim were good. The third party was English and so a claim was pursued against the third party and his insurance company here in England.
A letter of claim was sent to the third party. The third party insurers offered a split on liability of 50/50. They served witness evidence, which held claimant and defendant equally liable for the accident. Proceedings were served. Solicitors for the Defendant responded formally to the claim against the third party. Part 36 offer was made in the sum of £6,000.00. The claim then settled for £7,000.00 plus reasonable costs to be assessed.
