Workplace Accident in Belgium
Irwin Mitchell have successfully recovered compensation for our client, Hugh Herdman, following his workplace accident in Belgium.
Our client, was a lorry driver who had to collect pallets of books from a company in Belgium. He was told to walk down a flight of steps to the loading bay. It was dark and the steps had no hand rail. The steps were uneven and slippery. Hugh slipped and fell to the bottom.
He suffered a serious knee injury and has not been able to return to work as a lorry driver.
On behalf of Hugh, we brought a claim in Belgium against the owner of the building. The Court in Belgium rejected the case. We were very disappointed because we believed that Hugh had a strong claim so we appealed the decision.
The Court of Appeal decided that the owners were responsible for Hugh's accident because they had not made sure that the steps complied with Belgian safety law.
We were very pleased that our determination paid off for Hugh. He has since been awarded compensation for his injury and the fact that he won't be able to return to his work.
