Lawyers representing a couple who say their five-star Moroccan holiday was ruined after falling ill with severe gastric symptoms and after one of the pair contracted salmonella have launched court proceedings in a bid to help them get justice.

Edward and Marie Caunt, from Woodborough in Nottingham, fell ill mid-way through an 11-night guided tour of Morocco in September 2011 and on their return home Mrs Caunt was horrified to learn from her GP that she had salmonella poisoning.

The couple instructed international travel law experts at Irwin Mitchell to investigate what caused their severe sickness, diarrhoea and stomach cramps which began halfway through their trip and was two days after they checked into the Hotel Palais Medina & Spa in the town of Fes.

Now, the law firm has issued court proceedings against Kuoni Travel Limited, who the couple booked their tour through, in a bid to secure them justice.

Elizabeth Tetzner, a travel law expert at Irwin Mitchell who specialises in helping people who suffer illness abroad, said: “Mr and Mrs Caunt both suffered severe gastric illness that left them unable to enjoy what was left of their tour.

“Aside from making holidays extremely unpleasant, salmonella can have a debilitating long-term impact on victims’ health. When booking their break the last thing on this couple’s mind was that illness would ruin their luxury holiday. We are now supporting them in their quest for answers as to what caused them to fall ill.

“We have liaised with Kuoni to investigate our clients’ claims but as the matter has not been resolved we have issued court proceedings which we hope will settle the case once and for all.”

Mrs Caunt, 71, said: “My husband and I had always wanted to go to Morocco but were concerned about booking it ourselves so we chose Kuoni as it offered a tour with five star hotels which we expected would come with a high level of quality and service.

“But mid-way through our trip after we had checked into the Hotel Palais Medina & Spa we both became ill with awful sickness and diarrhoea which meant we struggled to continue with a tour of Fes and had to see a doctor at the hotel.

“Our symptoms got no better and we missed seeing the Atlas Mountains and getting to sleep in a Bedouin style tent which were the main reasons we booked the trip – we were devastated that after looking forward to it for so long, our holiday was ruined.

“After my GP confirmed I had contracted salmonella I was horrified and we instructed lawyers at Irwin Mitchell as we wanted answers about why this had happened and accountability in the hope no one else has to go through a similar ordeal. It is frustrating that our legal team have had to issue proceedings but we are determined to ascertain what caused us to fall ill.”
