Motorcycle Fatality in Florida

Irwin Mitchell is acting on behalf of the families of two clients following a tragic accident which occurred whilst they were on holiday with their children in Florida in March 2008. Mr R, a heart specialist and his wife a GP, Mrs R, were on holiday in Florida and hired a Harley Davidson Motorcycle to ride along the coast road.  

Tragically, on 30th March 2008 whilst riding along the Florida highway, a pickup truck turned across their path and they were unable to avoid colliding with the side of the truck. It is believed that Mr and Mrs R were killed instantly.

The case has provided many challenges for travel litigation specialists at Irwin Mitchell, particularly due to the location of the accident and because of the sensitive nature of the case, the accident leaving three children orphaned. 

A significant additional difficulty has arisen due to the fact that the pickup driver who pulled out on the motorcyclists had very limited insurance. Lawyers at Irwin Mitchell, working in conjunction with Florida lawyers, have therefore had to consider additional causes of action. A seven figure US Dollars payment has been secured from Harley Davidson following allegations of under insurance. Investigations are also underway in relation to the alleged inadequacy of the helmets provided by Harley Davidson.
