Road Traffic Collision In France

Irwin Mitchell have been instructed by Mr and Mrs W who were injured in a car crash while on holiday in France in October 2010.

Our clients were driving along a country road and were approaching a hill when a driver of a car travelling in the opposite direction lost control of her vehicle.  The vehicle travelling in the opposite direction spun out of control and Mr W was unable to manoeuvre his car to get out of the path of the other vehicle.  The two cars collided.  Mr W suffered whiplash injuries to his neck as well as an injury to his ankle.  Mrs W suffered whiplash injuries to her neck and an injury to her sternum which is ongoing.

Under French law, Mrs W would have been able to claim compensation against the driver of her vehicle, in this case Mr W, even if the accident was not his fault.  Mr and Mrs W decided, however, to only pursue the third party driver.  Irwin Mitchell were able to trace the UK Claims Handlers of the French Insurers which allows us to bring Mr and Mrs W’s claim in this country.  The Defendants have admitted liability and we are now in the process of obtaining medical evidence in relation to Mr and Mrs W’s injuries with a view to submitting a valuation in respect of the losses that they have suffered as a result of the incident.
