Claim for British Tourist After Slip at Caledonia Park Hotel in Tenerife
A British tourist was on holiday in Tenerife with his family on 28th July 2005. He had booked a 14 night package holiday with Airtours to stay at the Caledonia Park Hotel on an all inclusive basis.
On 28th July 2005 the Claimant was making his way to the squash courts to play an early morning game of squash with some other British tourists he had met during his stay. The Claimant walked through a bar/restaurant area and down some stairs towards the squash courts. The stairs were made of smooth terracotta tiles with two flights separated by a landing; there was no handrail. As the Claimant made his way through the bar/restaurant he was passed by the hotel cleaners who were walking in the opposite direction with their cleaning equipment. The Claimant got to the top of the stairs and was about to take his first step his foot gave way and he fell down the stairs. The stairs were very wet and slippery as the cleaners had just cleaned them and failed to put up any warning signs.
The Claimant sustained a fracture to his coccyx, extensive bruising to his buttocks and aggravation of a pre-existing back condition. He was taken to hospital in Tenerife where X-rays confirmed the fracture. The Claimant was unable to enjoy the remainder of his holiday and spent most of the time lying down to minimise the pain. On his return to the UK he attended the local hospital and was advised that he would have to give the fracture time to heal.
Irwin Mitchell were instructed by the Claimant’s travel insurers and following extensive negotiations with the Defendant’s legal representatives, were able to agree settlement in January 2009 in the sum of £4,500.00.
