GP Injured in Swimming Pool Accident in Cuba Recovers Compensation

Irwin Mitchell represented a GP, who was injured in a hotel swimming pool in Cuba, when a member of hotel entertainment staff threw another hotel guest on top of her during an organised pool game, in 2006. Our client initially fractured her leg, but when the pain spread to her foot and other parts of her body it became clear that her injuries were more serious.

As a result of her injuries, she was unable to work for an extended period of time and although she now works part-time as a GP, it is unlikely that she will able to work full time again. Her life has been further restricted as the pain she suffers makes every day tasks difficult and she needs lots of assistance with house hold tasks and childcare. Our client also has to pay expensive medical bills, as the treatment that best reduces her pain is not available from the NHS.

Solicitor Cheryl Palmer-Hughes acted for our client in her claim against First Choice Holidays, who denied responsibility for her pain. After tough negotiations, Irwin Mitchell successfully obtained a substantial six figure settlement which included a claim for loss of earnings and medical treatment as well as money to compensate her for her pain and suffering.

"We were very happy with the outcome of our case, especially as we were initially offered nothing from the Tour Operator. Irwin Mitchell were very professional throughout and we are very happy with the outcome."
