Man Injured By Falling Ceiling At Sirenis Club Aura, Ibiza
Irwin Mitchell’s travel law team are currently representing a man who was injured whilst holidaying at Sirenis Club Aura, Ibiza.
Mr Byrne was standing in the bath taking a shower when the ceiling of the hotel bathroom collapsed on top of him. The force of the collapse caused him to fall over and his partner had to remove the rubble which had fallen on top of him before he could get out of the bath.
Mr Byrne suffered soft tissue injuries to the neck, shoulders and ribcage and also had dental injuries which resulted in him having teeth removed. Following the accident he approached Irwin Mitchell for assistance in making a claim against Thomas Cook.
Irwin Mitchell pursued the claim under “The Package Travel, Package Holidays and Package Tours Regulations 1992”, as Mr Byrne had booked both the flights and accommodation with Thomas Cook which deemed the holiday as a 'package'.
After obtaining medical evidence to support his claim, Thomas Cook admitted they were at fault. Negotiations to agree an appropriate level of compensation are now underway.
