Over £20,000 damages for British tourist after Slip in Tenerife
We successfully recovered compensation of over £20,000 for our client, John Kelly, following an accident while he was on holiday with his family in Tenerife in September 2007.
Mr Kelly had booked a 14-night package holiday with First Choice to stay at the Ocean Resort. On 3rd September 2007, Mr Kelly was walking from the swimming pool to his sun lounger with his 2 year old daughter. The pool and surrounding area were tiled with signs stating that there should be no running on the slippery surface. Mr Kelly was holding on to his daughter’s hand and was walking carefully down some steps. He suddenly felt his feet give way beneath him, and on realising that he was going to fall, he gently pushed his daughter to the side to stop her from falling as well. Mr Kelly fell on the steps hitting the left side of his head and landing on his side. Mr Kelly fell because the steps were slippery and there was no handrail to hold on to.
Mr Kelly was seen by the hotel doctor, who advised him to take painkillers and rest. A few days later he was in severe pain and was taken to the local hospital, where he was diagnosed with broken ribs, a cut to his head and a sprain to his neck; he was kept in overnight for observation. Mr Kelly suffered with ongoing headaches and had difficulty breathing for some time after the accident. He was unable to work for approximately 2 months. Mr Kelly has also been left with discomfort in his ribs and had some ongoing pain.
Irwin Mitchell were instructed by Mr. Kelly and following extensive liability investigations and negotiations with First Choice’s legal representatives, we were able to negotiate a compensation payment for Mr Kelly of over £20,000.
