Pool Accident Leads to Compensation

Irwin Mitchell represented Mr Christopher Wharmby from Lancashire, after he sustained an injury following an accident whilst on holiday at the Sunrise Makadi Bay Hotel in Egypt, on 14 September 2008.

Mr Wharmby booked his holiday through Thomas Cook. On the day of his accident Mr Wharmby was using the family swimming pool. When he was in the water, he placed his feet on the floor of the pool and felt something sharp hit his right big toe. On coming out of the pool Mr Wharmby noticed that his toe had been severely cut and flesh was hanging from the toe. Upon inspecting the pool area Mr Wharmby noticed that he had cut his toe on a large broken tile on the floor of the swimming pool.

Irwin Mitchell pursued a claim against Thomas Cook under the Package Travel, Package Holidays and Package Tour Regulations 1992 and recovered £2,000 in damages.
