Over £40,000 Compensation Recovered Following Illness At The Brisas Guardalavaca In Cuba

16 holidaymakers recovered over £40,000 in compensation after an outbreak of illness at the Brisas Hotel in Guardalavaca in Cuba.

Irwin Mitchell were successful in recovering damages from tour operator Thomas Cook on behalf of 16 holidaymakers who stayed at the as Hotel between August and September 2006 after their holidays were ruined by illness.

Holidaymakers complained about the quality and cleanliness of the accommodation, the poor quality of the food on offer in the hotel restaurant, the poor hygiene conditions employed in the restaurant, the cleanliness of the swimming pool and about the poor attitude of the staff and tour representatives.

Irwin Mitchell succeeded in recovering over £40,000 in compensation for their clients.  The tour operator also agreed to cover their legal costs. The highest award for the most seriously ill of our clients was over £11,000.

Elaine from Sunderland went on holiday with a family party of 5 to include her husband, mother, sister and brother in law and nephew to the Brisas Hotel in August/September 2006. Following a few days at the hotel all members of her party fell ill suffering with symptoms of diarrhoea and sickness. Upon returning home all 5 members of the party continued to suffer illness.

Fortunately apart from Elaine and her mother all other members of the party fully recovered from their illness within 3 to 4 weeks and received damages ranging from £1500 - £2500

However, Elaine and her mother are continuing to suffer from Irritable Bowel Syndrome.  Elaine recovered £11,000 and her mother recovered £9,500 in compensation.  Elaine said “Thank you so much to Irwin Mitchell for their help with our claim, Irwin Mitchell were fabulous!”
