Illness Outbreaks at Camino Del Sol Hotel, Dominican Republic
29 holidaymakers win over £314,000 after holidaying at the Camino Del Sol Hotel, Cabarete, Dominican Republic in 1997.
We recovered damages for 29 people who stayed at the Camino Del Sol Hotel, Cabarete in the Dominican Republic in summer 1997 after their holidays were ruined when a breakdown in food hygiene procedures at the hotel resulted in all of the holidaymakers contracting gastric illness.
1 holidaymaker was proven to have been infected with giardia and another was shown to have contracted shigella. 17 of the holidaymakers developed permanent Irritable Bowel Syndrome as a result of the infections they picked up during their holidays.
JMC Holidays Ltd admitted that they were liable for the claims and settlement negotiations resulted in us recovering over £314,000 in compensation for our clients. The highest award for the most seriously ill of our clients was almost £29,000.
Mr Maguire, went on an all-inclusive holiday to the Camino Del Sol Hotel with his wife and 2 children. Three days into the holiday, Mr Maguire began to suffer from symptoms including diarrhoea, abdominal pains and stomach cramps. His symptoms continued upon return to the UK and he had to have time off work. His symptoms also affected his social life. He developed intolerance to certain foods. After numerous tests and investigations, medical experts concluded that his symptoms were unlikely to resolve completely and confirmed that the original gastrointestinal infection had caused him to develop post infective Irritable Bowel Syndrome.
After careful negotiations, and bearing in mind the permanent nature of his symptoms, his claim was settled for over £20,000.
