LTI Beach Hotel, Punta Cana
Irwin Mitchell represented 10 Claimants who stayed at the LTI Beach Hotel in Punta Cana, Dominican Republic in August 2004, after booking holidays with First Choice.
The holidaymakers complained that the 4 star hotel did not live up to its rating, and the rooms seemed old fashioned and in need of re-decorating. The toilet in the room did not always flush properly.
The holidaymakers also complained that the food being served in the restaurant was bland and tasteless and some of it tasted as though it had been re-heated. The food was said to be left out for a long time and flies were seen on around the food, particularly the salad and fruit.
The holidaymakers were concerned that their complaints to the representative were not heeded and that the representative only seemed to be at the hotel for an hour a day.
Following negotiations with First Choice, Irwin Mitchell was able to recover damages totalling more than £40,000 for the group. First Choice also agreed to pay their legal costs.
One guest from Hertfordshire fell ill a couple of days after arriving at the resort with an acute gastric illness. He was unable to enjoy the entertainment provided by the hotel and had been really looking forward to going jet skiing but was unable to do this because he was ill.
Fortunately he made a full recovery from his illness although other members of his family were also affected both on holiday and on return from holiday. He received £3,100 in damages with the help of Irwin Mitchell.
