Couple successfully brings claim against UK Tour Operator after holidaying at the Barcelo Club Hotel, Mexico in 2005.

Irwin Mitchell represented a young couple who holidayed at the Barcelo Club Hotel in Mexico in 2005.  Upon booking, the couple had requested a room with a balcony, to have a sea view and to be located in a quiet location. Instead, they were given a room with a 7 foot drop down on to an area covered in extractor fans, and overlooking the servant’s delivery entrance.  Subsequently, the couple suffered from sleep disturbance due to the high noise levels caused by night deliveries. The couple requested a room change which was refused.

There were other quality problems with the room, for example, it had a strong smell of dampness, the cushions in the room were covered in mould and the bedding was mouldy and damp. The chairs were also covered in mould.

A variety of photographs were taken by the couple, which proved to be very helpful in supporting their allegations.

One of the clients fell ill with symptoms of severe gastric illness, lasting for almost a month in their duration.

Following settlement negotiations between the tour operator, Air Tours and Irwin Mitchell, the couple were awarded almost £4,750.00 in compensation.
