Couple win compensation after illness ruins holiday at the Costa Real Hotel in Cancun, Mexico in 2000
Irwin Mitchell acted for a couple who holidayed at the Costa Real Hotel in Cancun, Mexico in 2000. One of our clients had booked the holiday as a present for her boyfriend’s birthday. She contracted salmonella food poisoning during the holiday, and she required medical attention once she got home. She went on to develop Irritable Bowel Syndrome as a result of the infection contracted during the holiday. Her partner also suffered similar gastric illness for around 2 weeks. In addition to suffering illness, our clients complained that the toilet in their hotel room leaked which caused an unpleasant smell. The couple also noticed that food was often left out for long periods of time, cold food was not refrigerated and food was often undercooked.
Following settlement negotiations between tour operator JMC Holidays Ltd and Irwin Mitchell the couple were awarded £2,500 in compensation. The tour operator also agreed to cover their legal costs.
