Irwin Mitchell acted for 9 holidaymakers who stayed at the Monika Apartments in Spain in August and September 2009 and who became ill with sickness and diarrhoea. One of the children in the group was diagnosed as suffering from Cryptosporidium, which is a waterborne parasitic infection.
Negotiations between the tour operator and Irwin Mitchell resulted in the holidaymakers recovering over £18,000 in compensation after their family holidays was spoilt by the conditions at the hotel and the illness which affected family members. The tour operator also agreed to cover their legal costs.
One holidaymaker from Sheffield who went on holiday with his wife and 2 children was left with serious symptoms which continued on return home and meant that he had to have time off work. To start with, he was offered an unsuitable room which did not have enough room to sleep all of his family. There were long queues for food in the hotel restaurant. He describes the food that was being served as being poor quality, with chicken that was undercooked and food that was often lukewarm. He complained that the knives and forks were not clean and there were ants on the floor of the restaurant. The hotel swimming pool also caused him concern as there were broken tiles in and around the pool and the pool water did not seem very clean. He became ill about 3 days into his holiday. He describes feeling dizzy and light headed before beginning to experience diarrhoea and vomiting. He was so unwell that he was not always able to make it to the toilet.
He recovered in excess of £5000 for his illness and his ruined holiday with the assistance of Irwin Mitchell despite receiving correspondence from the Tour Operator denying that the illness he suffered was caused by the conditions at the hotel.
