Flight Attendant Sues International Airline
Irwin Mitchell has successfully won compensation for Ms M for the injuries she suffered in February 2007 when working as a flight attendant for an international airline on board a flight from London Heathrow to Los Angeles airport.
Approximately 1 hour 30 minutes into the flight, Ms M. was asked by a passenger for her baby food which was located at the back of the plane’s Kitchen facilities. As she went to collect the food, she noticed that the floor and the side food preparation area were wet. Ms. M. moved with the intention of getting some paper towels to clean the area up and in doing so, she slipped on the water and fell. As she fell, she felt a thud to her head.
Ms M. recalls getting up and trying to dry the floor and her skirt and then tried to commence with her duties. However, during the rest of the flight, Ms M was very disorientated and felt very unwell. As the flight progressed, Ms M’s condition became worse and she began vomiting and was unable to continue with her duties.
The flight continued and on arrival at the destination, Ms M. went to hospital where she underwent an operation where she had to have cerebral spinal fluid drained which resulted in plates being inserted in her head. She suffered from two brain haemorrhages and now has many ongoing problems including, partial right sided paralysis especially in the face, loss of communication skills, complete loss of sense of smell, complete loss of sense of taste, digestive problems, diminished sense of touch, loss of pain sensation and severe headaches to name a few.
After liability was agreed, Irwin Mitchell continued to obtain the medical evidence needed to value Ms M’s claim. Due to the seriousness of her condition, Ms M has been unable to work since the accident and therefore claimed compensation for her loss of earnings, as well as for her pain and suffering, medical treatment and other expenses.
After negotiations with the airline’s solicitors, Irwin Mitchell secured a substantial settlement for Ms M. Ms M is now rebuilding her future with the help of her family, due to the dedicated work of the Irwin Mitchell team.
