Canadian Road Traffic Accident
Irwin Mitchell have successfully acted for two clients who were involved in a road traffic accident that occurred during the course of their holiday in Canada in May 2003.
Our clients had travelled to the USA, hired a car in Boston and drove up through New England stopping in Kingston to find a cottage to rent for their stay. At the time of the accident one client was travelling as a front seat passenger and the other was travelling in the seat behind her. The driver of their vehicle was waiting to turn left across the path of oncoming traffic when a second vehicle was coming in the opposite direction although it is not clear if he was intending to turn. The second vehicle struck the passenger side of the vehicle in which our clients were travelling and the car was spun anticlockwise striking vehicle another vehicle.
The front seat client sustained four fractured ribs and a fractured collarbone and a partially collapsed lung on the right side as well as cuts to her face which has resulted in small scars and also bashed her left knee quite badly. She broke two back teeth and cracked two front teeth. In addition to those physical injuries she also has psychological problems and finds that she does not now like car travel.
The back seat client sustained severe facial injuries. All of her front teeth were knocked out and her top lip was split right through between the lip and the nose. Her nostril split on the left side and her nose was fractured. She fractured a number of ribs on both sides and punctured her lung. She was knocked unconscious and did not wake up until she was in the accident and emergency room and the sutures were being inserted.
After a long fought battle, the clients’ cases have now resolved for in excess of $100,000 (Canadian dollars).
