Legal 500 (2016)

Record Damages recovered following French road traffic accident

We recently settled a claim for our client, Alison Grant, who was just 35 when her car was hit by a speeding drunk driver in France in 2004.

Because of the accident, Alison suffered catastrophic injuries to her spine, leaving her wheelchair-dependent with limited movement in her lower body and hands, and in need of 24 hour care. Following a legal claim brought through our Travel Team, we successfully recovered what is thought to be a record amount of damages following a road traffic accident abroad.
Before her accident, our client’s life was full of action. She had a good career as an Army Major within the Queen Alexandra Nursing Corps, and she was an extremely active sportswoman. She especially loved skiing. Following intensive physiotherapy and with the assistance of specialist organisations and disabled equipment, Alison has been able to return to some of the sports she loves. As well as skiing, she has also become very involved with her local sailing club, which has seen her competing in events both in this country and overseas, including recent participation at the European Championships in Lake Garda, Italy. On top of all of this, Alison has also managed to find time to take microlight flying lessons and complete a law degree at Southampton University. All of this may not have been possible had Alison not sought the help of our specialist travel team, who enabled her to secure a lifetime of specialist care and rehabilitation following her accident.

The Partner who handled the case, Michael Zurbrugg, said: "It is important that the compensation Alison will receive is not seen as a lottery win. It will go towards ensuring that she has access to the care and rehabilitation she needs now, and in the future, so that she is able to live as normal a life as possible with the injuries she has sustained…Alison is a truly inspirational character and I am extremely pleased to have helped her secure the funds she needs for her future care, and to help in her future career and sporting achievements."

Commenting on her accident, Alison said: "Simple tasks are a daily challenge for me now. Continuing rehabilitation therapy is essential and my sporting activities have had to be adapted, but, thanks to the amazing support of so many people and the financial independence that Michael Zurbrugg and Irwin Mitchell have achieved for me, I am able to continue to take part."

Alison, now 42 years old, is thinking only of the future.

"We were very happy with the outcome of our case, especially as we were initially offered nothing from the Tour Operator. Irwin Mitchell were very professional throughout and we are very happy with the outcome."
